European Union and humanitarian action

Abstract

Οι αντιθετικές εικόνες της ανθρωπιστικής βοήθειας σε ένοπλες συγκρούσεις συνθέτουν μια περίπλοκη εικόνα.Αυτή τη στιγμή, υπάρχει πληθώρα δημόσιων και ιδιωτικών οργανισμών οι οποίοι λαμβάνουν ανθρωπιστική δράση σε όλο το πλανήτη. Ρόλος τους είναι να σώζουν ζωές και να απαλύνουν το πόνο των ανθρώπων οι οποίοι δεν αποτελούν μέρος μιας σύγκρουσης και οι οποίοι στερούνται των βασικών δικαιωμάτων της ζωής λόγω του ότι είναι εκτεθειμένοι σε συγκρούσεις. Οι οργανισμοί οι οποίοι είναι υπεύθυνοι για την ενεργοποίηση και την επιβολή του Διεθνούς Ανθρωπιστικού Δικαίου και των Ανθρώπινων Δικαιωμάτων, προσπαθούν να λάβουν σοβαρή δράση εναντίον εκείνων των μερών των συγκρούσεων τα οποία παρεμποδίζουν την ανθρωπιστική βοήθεια.Παρόλα αυτά έχει γίνει εμφανές ότι ένα τεράστιο μέρος από την απεσταλμένη βοήθεια καταλήγει σε λάθος χέρια, όπως επίσης και το ότι τα δύο μέρη μιας σύγκρουσης πολλές φορές αρνούνται την ανθρωπιστική βοήθεια χωρίς κάποιο επιχείρημα, με την ανθρωπιστική βοήθεια χρησιμοποιείται ως όπλο από τα συγκρουόμενα μέρη. Υπάρχουν κάποιες περιπτώσεις στις οποίες η διεθνής κοινότητα επιδιώκει να δώσει αποζημιώσεις για την έλλειψη προστασίας κατά σοβαρών παραβιάσεων του διεθνούς νόμου στέλνοντας βοήθεια στα θύματα μιας σύγκρουσης παρατείνοντας με αυτό τον τρόπο την οδύνης τους. Αυτό το ζήτημα χρήζει μιας εξέτασης του νόμου ο οποίος διέπει την ανθρωπιστική βοήθεια στην Ευρωπαϊκή Ένωση, της προόδου του μέχρι και σήμερα καθώς και των ελλείψεών του.

Contradictory images of humanitarian assistance in armed conflict comprise a confusing picture. At this moment, there are plenty of public and private humanitarian organizations that operate across the continent. Their work is supposed to help save lives as well as to alleviate the suffering of the people that do not comprise part of a conflict and are thus deprived from the basic necessities of life due to the fact that they are exposed to conflict. The organizations that are responsible for the enforce-ment of international humanitarian law and international human rights are trying to take serious actions towards parties of a conflict that obstruct efforts to provide hu-manitarian assistance. However, is has become conspicuous that a vague proportion of relief supplies ends up in the hands of combatants, that parties to a conflict sometimes reject the of-fer or such help for victims of the conflict with no reasonable explanation and that sometimes humanitarian actions is used as a weapon for war by the belligerents. There are some cases in which the international community attempts to give compensations for the lack of protection against serious violations of international law by sending relief supplies for the victims of the conflict thus prolonging their suffering. This issue raises an examination of the law that is regulating humanitarian as-sistance in the European Union, the progress made to date and the gaps in regulation that need to be filled, it concludes with a study case regarding the European Union’s intervention in Bosnia.
